CONCERNING
STIPULATION OF IMPORT DUTY TARIFF ON THE IMPORTED GOODS WITHIN THE FRAMEWORK OF ASEAN-AUSTRALIA-NEW ZEALAND FREE TRADE AREA (AANZFTA)

Attachment

Considering:

a. that in an effort to enhance economic cooperation among ASEAN member countries, Australia, and New Zealand, Government of the Republic of Indonesia has ratified the Agreement Establishing the ASEAN-Australia-New Zealand Free Trade Area under Presidential Regulation No. 26/2011 concerning Ratification of Establishing the ASEAN-Australia-New Zealand Free Trade Area;

b. that based on agreed modality for Indonesia, timetable for the reduction of import duty tariff within the framework of ASEAN-Australia-New Zealand Free Trade Area (AANZFTA);

c. that based on consideration as intended in paragraph a and paragraph b above, and in effort to implement provision in Article 13 paragraph (2) of Law No. 10/1995 concerning Customs as amended by Law No. 17/2006, it is necessary to stipulate Regulation of the Minister of Finance concerning Stipulation of Import Duty Tariff on the Imported Goods within the Framework of ASEAN-Australia-New Zealand Free Trade Area (AANZFTA);

In view of:

1. Law No. 7/1994 concerning Ratification of Agreement Establishing The World Trade Organization (Statute Book of the Republic of Indonesia No. 57/1994, Supplement to Statute Book of the Republic of Indonesia No. 3564);

2. Law No. 10/1995 concerning Customs (Statute Book of the Republic of Indonesia No. 75/1995, Supplement to Statute Book of the Republic of Indonesia No. 3612), as amended by Law No. 17/2006 (Statute Book of the Republic of Indonesia No. 93/2006, Supplement to Statute Book of the Republic of Indonesia No. 4661);

3. Presidential Decree No. 26/2011 concerning Ratification of Establishing the ASEAN-Australia-New Zealand Free Trade Area (Statute Book of the Republic of Indonesia No. 55/2011);

4. Presidential Decree No. 56/P/2010;

Observing:

Letter of the Minister of Trade No. 812/M-DAG/SD/5/2011 dated May 30, 2011 with subject of Issuance of Regulation of the Minister of Finance (legal enactment) on the Implementation of AANZFTA Trading Goods Tariff Commitment;

DECIDES:

To stipulate:

REGULATION OF THE MINISTER OF FINANCE CONCERNING STIPULATION OF IMPORT DUTY TARIFF ON THE IMPORTED GOODS WITHIN THE FRAMEWORK OF ASEAN-AUSTRALIA-NEW ZEALAND FREE TRADE AREA (AANZFTA)

Article 1

(1) To stipulate the import duty tariff on the imported goods from ASEAN member countries, Australia, and New Zealand within the framework of ASEAN-Australia-New Zealand Free Trade Area (AANZFTA) for 2011 until 2013 period, is stated in Attachment to this Regulation of the Minister of Finance that is an integral part of this Regulation of the Minister of Finance.

(2) On the stipulation of import duty tariff as intended in paragraph (1), following provisions shall apply:

• a. Stipulation of import duty tariff as stated in column (5) of Attachment to this Regulation of the Minister of Finance, starting from the date of this Regulation of the Minister of Finance is promulgated until December 31, 2011.
• b. Stipulation of import duty tariff as stated in column (6) of Attachment to this Regulation of the Minister of Finance, starting from January 1, 2012 until December 31, 2012.
• c. Stipulation of import duty tariff as stated in column (7) of Attachment to this Regulation of the Minister of Finance, starting from January 1, 2013 until December 31, 2013.

Article 2

(1) Imposition of import duty based on import duty tariff as intended in Article 1 shall be implemented as follows:

• a. Import duty tariff within the framework of ASEAN-Australia-New Zealand Free Trade Area (AANZFTA) is lower than general import duty tariff, only be applied on the imported goods equipped with a Certificate of Origin (Form AANZ) that is signed by authorized official in the origin country;
• b. Importers shall put reference number of Certificate of Origin (Form AANZ) as intended in paragraph a and facilitation code within the framework of ASEAN-Australia-New Zealand Free Trade Area (AANZFTA), at notification of imported goods;
• c. The original sheet of Certificate of Origin (Form AANZ) within the framework of ASEAN-Australia-New Zealand Free Trade Area (AANZFTA) as intended in paragraph a, shall be delivered by the importers on the submission of notification of imported goods as intended in paragraph b at Customs Office at the port of entry; and
• d. In case general import duty tariff is lower that import duty tariff within the framework of ASEAN-Australia-New Zealand Free Trade Area (AANZFTA) as stated in Attachment to this Regulation of the Minister of Finance, tariff that is used is general import duty tariff.

(2) Further provision on the technical guideline to implement checking of Certificate of Origin (Form AANZ) to implement provision on the Rules of Origin within the framework of ASEAN-Australia-New Zealand Free Trade Area (AANZFTA), will be regulated by Regulation of the Director General of Customs and Excise.

Article 3

Provisions in this Regulation of the Minister of Finance shall apply to the imports of goods whose import notifications have obtained registration numbers from the Customs Office at the port of entry.

Article 4

Director General of Customs and Excise is instructed to implement provisions in this Regulation of the Minister of Finance.

Article 5

This Regulation of the Minister of Finance shall come into force 60 (sixty) days after the date of promulgation.

For public cognizance, this Regulation of the Minister of Finance shall be promulgated by placing it in the State Gazette of the Republic of Indonesia.
